Along with the federal and North Carolina state government’s pending antitrust suit against Carolinas HealthCare System, based in Charlotte, N.C., the San Francisco-based law firm of Lieff Cabraser Heimann & Bernstein seeks Charlotte-area residents who could sue for related damages.
The governments’ suit alleges that Carolinas Healthcare used its market power to force restrictions in contracts with every major health insurer in the area, thus boosting healthcare costs by reducing competition.
Although Lieff Cabraser’s investigation is preliminary, it could lead to a class-action suit.
Carolinas has filed a motion to dismiss the governments’ suit on the grounds that the U.S. Department of Justice hasn’t provided evidence that the contract provisions caused higher insurance-premium prices or financially marginalized other area hospitals in the market.
